Introduction

1. These are the general terms and conditions (the “Terms”) governing your access and use of the content and services offered to you by Globaltravelbook Malta (“GTB”) via the website www.globaltravelbook.com (the “Website”, which term includes any current or future version of the same).
2. GTB is the owner and the operator of the Website. GTB is a partnership registered under the laws of Malta with company number C107877 and having its registered office at 27, The Vineyard, Swieqi Road, Swieqi, Malta, with VAT number MT30852532. 3. GTB offers an online booking platform enabling users (“Users”) to search for, book and use services organised and provided by third parties, hereinafter referred to as “Service Providers”. The Website operates as a platform wherein Users and Service Providers come together, and whereby Users can book activities, excursions and events (“Experience/s”) organised by Service Providers and advertised by the Service Providers on the Website.  For the avoidance of doubt, GTB shall not, for all intents and purposes at law, be a party to any agreement or contract entered into between a User and Service Provider, and neither shall any agreement expand or restrict the rights of GTB pursuant to these Terms.
4. These Terms constitute an agreement between you and GTB. By viewing and/or using this website, booking an Experience with a Service Provider via the online booking service or the Website and/or using any other service that GTB provides through the Website (whether now or in the future), you are deemed to have read and agreed to be legally bound by these Terms.
5. These Terms shall take effect immediately on your first use of the Website.
6. Should you not agree to each and every term and condition set out herein, you are asked not to use this Website and to leave immediately.
7. GTB reserves the right to change these Terms at any time without notice. Any such changes will be listed in this section of the Website and your continued use of the Website constitutes your agreement to be bound by these Terms.

9. These Terms are only available in English.

GTB recommends that you read these Terms carefully, and take your time to familiarise yourself with the contents of these Terms before using the Website. It is your responsibility to check this page regularly to ensure you are conversant with any changes.

• Booking

• To use GTB’s online booking service, you must be over the age of 18 years or possess legal parental or guardian consent, are fully able and competent to give the undertakings set out in these Terms, and to abide by and comply with these Terms.

• By using the information and services available through the Website:
  • you warrant that you are of age and have the legal capacity to enter into agreements with GTB;
  • you agree to accept full responsibility for all your activities on the Website and online booking; and
  • you are solely responsible for maintaining the confidentiality of your personal details, password and payment details.

• GTB reserves the right to refuse service at any time, terminate your access to the Website, or online booking, remove or edit any content or cancel your booking/s in its sole discretion.

• In the event of any issue relating to the booking with a Service Provider via the online booking service or Website or the Experience/s booked (including but not limited to issues relating to quality and customer service) kindly contact the Service Provider directly via the contact details set out on your booking form.

Cancellations

If you wish to cancel your reservation, the cancellation must be submitted in writing by the client who signed the booking form. GTB will refund any balance that has not yet been paid, or is not contractually obligated to be paid, to any third party. Travel insurance, which is required to be purchased before travel, is expected to cover cancellations. This insurance is intended to cover any expenses incurred by a client who must cancel their trip, though it is subject to its own terms and conditions.

• Using the Website

• GTB grants you permission to access the Website in accordance with these Terms provided that you:

• use the website for your personal use only;
  • do not copy, distribute or publish any part of the Website other than as may be necessary to use the Website for its intended purpose;
  • do not use any automated program or system in connection with the Website or its online ordering functionality;
  • do not collect any personally identifiable information from the Website, use communication systems provided by the Website for any commercial solicitation purposes, solicit for any reason whatsoever any Users with respect to their submissions to the Website, or publish or distribute any vouchers or codes in connection with the Website, or scrape or hack the Website; and
  • comply with the other provisions set out in these Terms.

• GTB’s Liability


• This section applies only to the extent permitted by law.

• GTB is not, in any way whatsoever, involved, directly or indirectly, in the organisation, management, arrangement and/or provision of such experiences, but merely facilitates the conclusion of arrangements between service providers and users by advertising such experiences on the website. Therefore, GTB shall and will, not be held responsible or liable for any and all claims, losses, damages, costs, expenses, injuries, illnesses, sickness, allergic reactions, accidents, death or theft, of a direct, indirect or consequential nature, arising out of or in connection with any experience/s booked with service providers via the online booking service or the website.
  • To the fullest extent permissible by law, GTB:

• excludes all representations and warranties relating to this Website and its contents or which is or may be provided by any Service Providers, affiliates or any other third party, including in relation to any inaccuracies or omissions in this Website and/or GTB’s literature; and
  • excludes any liability for any direct, indirect or consequential loss or damage which may arise out of or in connection with your use of this Website. This includes, without limitation, to any loss or damage caused to your computer, computer software, systems and programs and the data thereon.

• For the avoidance of doubt, GTB will not be held responsible or liable for any allergic or adverse reactions experienced by Users in relation to the consumption of any food and/or drink during any Experience, and therefore it is the sole responsibility of the User to communicate any food intolerances/allergy-related information to GTB and the Service Provider prior to the booking of the Experience.

• GTB is not responsible for ensuring that the relevant Service Provider has obtained the necessary licence, permit, registration or authorisation for the organisation and provision of the Experience. Furthermore, GTB is not responsible to ensure that the relevant Service Provider has obtained the necessary insurance for the organisation and provision of the Experience/s.

• Whilst GTB endeavours to allow uninterrupted access to the online booking service or the Website (twenty four (24) hours a day, seven (7) days a week), you acknowledge that access to the online booking service or the Website may be suspended, restricted or terminated at any time. In this respect, GTB does not warrant that you use of the online booking service via the Website or the use of the Website will be uninterrupted or error-free and GTB does not warrant that the information (or communication) transmitted via the online booking service or the Website will be transmitted reliably, accurately, in a timely manner or at all.

• The Website as well as the online booking service provided by GTB are provided on an “as is” basis and may be subject to delay or downtime. GTB does not accept liability for any errors or any omissions and reserves the right to change information, prices, specification and description of listed services. GTB will do its best to correct errors and omissions as quickly as practicable after being notified of them.

• Whilst GTB shall use its best efforts to accurately reproduce the descriptions, prices and any other information (“Experience Information”) from the information that is provided to GTB by Service Providers, the responsibility for the Experience Information (and the content and the factual correctness thereof) remains with the Service Providers. If you are in doubt about any of the Experience Information, you should confirm with GTB customer care directly before booking your Experience.

• GTB shall not be liable for any conduct or any publication of any content which violates these Terms, including without limitation any conduct or content which gives rise to civil or criminal liability.

• GTB does not guarantee that the online booking service or Website is free from viruses or anything else which may have a harmful effect on any technology. GTB assumes no responsibility for functionality which is dependent on your browser or other third-party software to operate (including, and not limited to, RSS feeds).

• You are solely responsible for the security of your password that you used to register with this Website. Unless GTB negligently discloses your password to a third party, it will not be held liable for any unauthorised transaction entered into using your name and password. Similarly, you agree that you shall maintain the entire risk arising out of your use of the online booking service or the Website, and any services arising in connection thereto, to the maximum extent possible under the applicable law.

• GTB reserves the right to change, substitute, suspend, alter, modify or remove without notice any information or service on the Website or forming part of the online booking service from time to time for any reasons and without notice. In any such case, GTB shall not be held liable for any such modification, discontinuance or termination.

• GTB reserves the right to block access to and/or to edit or remove any material which in its reasonable opinion may give rise to a breach of any of these Terms. Unfortunately, the transmission of information via the internet is not completely secure. Whilst GTB endeavours to take steps to protect your information, it cannot guarantee the security of your data transmitted to the Website; any transmission is at your own risk.

• Links to Other Websites (including Service Providers)

• GTB does not monitor or review the content of third party websites linked to the Website (including websites of Service Providers with which you may book an Experience via the online booking service or the Website) and such links are not an endorsement or recommendation by GTB of any information, products or services in such websites.

• GTB is not responsible for the privacy practices or content of third-party sites (including sites of Service Providers with which you may book an Experience via the online booking service or the Website) and you should evaluate the security and trustworthiness of any other site connected to this Website or accessed through this Website before disclosing any personal data to them.

• Payment and Billing

• All prices are in Euro (€). Except where indicated, prices include VAT (Value Added Tax).

• Users Representations and Warranties

• You hereby represent, warrant and covenant to GTB, that you shall:

  • provide true, accurate, current and complete information; and
  • maintain and promptly update all information to keep it true, accurate, current and complete.


• You hereby represent and confirm to GTB that information submitted by you for display on the Website (including any material submitted as feedback or a review of a Service Providers) shall not:

  • contain fraudulent information or make fraudulent offers of items;
  • violate any applicable law or regulation;
  • infringe or misappropriate any copyrights, trademarks, service marks or other intellectual property or other rights of any third party;
  • contain any material that constitutes unauthorized advertising or harassment (including but not limited to spamming), invades anyone’s privacy or encourages conduct that would constitute a criminal offence, give rise to civil liability, or otherwise violate any law or regulation;
  • contain any computer viruses or other destructive devices and codes that have the effect of damaging, interfering with, intercepting or expropriating any software or hardware system, data or personal information.

• User Generated Content
  • User generated content shall include any information, review, feedback, or content which Users publish, upload, or transmit to the Website (“User Generated Content”).

• You shall be entirely liable for the legality, veracity or accuracy of your User Generated Content and any claims arising therefrom.

• GTB shall maintain no liability for the content of your User Generated Content, given that GTB does not vet or control User Generated Content, and neither is it involved in the development, design or implication of such content.

• GTB simply acts as a passive conduit for the publication of such content. You agree that GTB has no obligation to monitor, vet, review, or filter User Generated Content. This is without prejudice to the right of GTB to remove, limit or restrict User Generated Content at its sole discretion.

• By making your User Generated Content available on the Website, you hereby grant GTB a non-exclusive, worldwide, perpetual, irrevocable, royalty-free, sub-licensable right to lawfully exercise the copyright, publicity, and database rights to that content.

• You release GTB from all liability for claims arising from the use or exploitation of such User Generated Content and acknowledges that GTB shall not be caused to provide financial or other remuneration for its rights to utilise User Generated Content for any lawful use.

• GTB shall be accessing and processing the User Generated Content only insofar as it allows GTB to provide statistics based on User data including but not limited to positive reviews and reliability.

• Force Majeure

• While every effort is made to meet your demands, cancellations or variations may be necessary as a result of circumstances beyond GTB’s control. GTB shall have no liability to you for any delay or failure to perform any of its obligations under these Terms or any other matters to the extent that the delay is due to any event outside GTB’s reasonable control. GTB shall have no liability (including liability for negligence) for the acts or omissions of telecommunications service providers or for failures of, or fault in, their networks and equipment.

Governing Law and Jurisdiction

These Terms shall be governed by and interpreted in accordance with the laws of Malta. By accessing this Website, you consent to the exclusive jurisdiction of the courts of Malta in all claims or disputes arising in relation to or in connection with this Website and its use and the Terms.

General

1. Failure of GTB to enforce any of the provisions set out in these Terms shall not be construed as a waiver of such provisions and shall not affect the validity of these Terms or of any pat thereof, or the right thereafter to enforce each and every provision.
2. If any provision of these Terms shall be held by any competent authority to be invalid or unenforceable in whole or in part, the validity of the remaining parts of these Terms and the remainder of the affected provision shall be unaffected.

Feedback

1. Any comments or suggestions that you may have and which may contribute to a better quality of service will be welcome and greatly appreciated.
2. If you have any questions about these Terms, the Privacy Policy or concerns about the way GTB processes your personal data, please contact GTB via email or by filling in the contact form found on the Website.

Further T&Cs mainly for Trips organised outside of Malta

• These conditions relate to all trips and experiences listen on the platform globaltravelbook.com
• If the Event is cancelled by the Organiser due to imposed travel restrictions and/or flight cancellations, the full payment will be refunded to the affected Participant, provided that the Organiser is reimbursed by third parties to whom payments would have been made such as airlines, transport, accommodation, etc.
• The Organiser has the right to refuse any participants without the need to provide any reason for doing so.
• The Participant shall abide by the terms and conditions of airline, train and any other carriage operators.
• The Organiser shall not be responsible for:
• Any changes in travelling scheduled by the Airline. Any additional  costs or change in price caused by such changes shall be borne entirely by the Participant;
• Any expenses arising from errors in the names and/or surnames of the Participant, as provided to the Organiser by the Participant;
• Any loss of luggage or personal property prior, during or after transit, to  and from any destination which is attributable to the transport or carriage  operators;
• Any liability for injury, loss, damage or expense attributable or caused by  the wilful or negligent misconduct of any participant for the whole duration of the cycling trip;
• Any loss of any participant in cases where such participant decides to wander separately from the group. Any participant is free to wander around at their own risk;
• Any of the Participant’s abusive, threatening, drunken or other anti-social  behaviour, or the carrying of offensive weapons or illegal or prohibited  substances. The Organiser dissociates himself from any such behaviour; and
• Any vaccinations and visas, as may be requested by the visiting country/ies.
• The Organiser strongly urges the Participant to purchase travel insurance.
• The Organiser urges the Participant to acquire an EHIC (E-111) card to safeguard themselves against any potential medical emergency.

I hereby declare that I have read and understood the entire contents of this Declaration, and I am aware of all the aforementioned terms and conditions set out by the Organiser. I hereby declare that I agree to such terms and conditions, out of my own free will, and was not coerced into signing this Declaration in any way, shape or form.
