  1. We at Globaltravelbook LTD (C107877) (hereinafter referred to as “GTB”) know that you, the user, care about how information about you is used, shared, and processed, and we appreciate your trust in using our services, herein is a description of our privacy policy (the “Policy”).
  1. This Policy explains how and for what purposes we use the information collected about you via www.globaltravelbook.com, the online booking service and through the services which we provide.
  1. The website is not intended for use by persons under eighteen (18) years of age, and by no means do we knowingly collect personal data in relation to children, except with the consent of the child’s parents or legal guardians.
  1.         Any processing of information gathered as a result of the use of this website by consumers or              other persons is governed by the provisions of data protection legislation, in particular                Regulation (EU) 2016/679 (“General Data Protection Regulation” or “GDPR”) and the Maltese        Data Protection Act (Chapter 586 of the Laws of Malta).
  1. Please read this Policy carefully, it can easily be accessed via a link at the bottom of each web page. By using the website and the online booking service and any services we offer, you are agreeing to be bound by this Policy in respect of the information collected about you.
  1. By making a booking or submitting any information via our online booking service or website, you are agreeing to us handing your personal information as set out below. If you do not agree to us using your personal information in these ways, then unfortunately we would not be able to process your booking and you should not visit the website.

  • We collect your personal information in order to be able to provide you with a better quality of service.
  • The following is a list of the information we gather:
  • Identity Data including your:
  • name;
  • surname;
  • date of birth;
  • address;
  • gender; and
  • nationality.
  • Contact Data; including your:
  • postal address;
  • email address; and
  • contact number.
  • If you are booking an activity, excursion or event (an “Experience”) with other persons or for someone else, you will also have to provide GTB with their information, such as their name and date of birth. In such a case, it is your responsibility to ensure that such persons are aware of the fact that you have shared their information with GTB and also that they accept how GTB uses and processes their information as well as yours.
  • With respect to the collection, use and processing of personal information of children, you are only permitted to book through the online booking service of website if you over 18 years of age. GTB only will only collect, use and process information about children with the consent of their parents or legal guardians.
  • Any other information you voluntarily provide.
  • We may also carry out background checks in order to verify the personal information which you provide us with. 
  • How we collect your data:
  • When you book an Experience/s with a third party (a “Service Provider”) via the online booking service or website;
    • Information provided at the time of sign up for our email newsletters;
    • When you register for any loyalty scheme that we offer from time to time;
    • When you request that promotional emails be sent to you;
    • Information provided when completing surveys for research purposes;
    • Information provided when you contact our team; and
    • Any other time you provide any information about yourself.
  • How we use your information
  • We use your information in the following ways:
  • To process your booking/s;
    • to improve the GTB platform as best suited to your requirements;
    • to send you service messages by email, SMS or otherwise;
    • to provide customer care and support;
    • for security and to check your identity;
    • to provide you with marketing or promotional material (where you have consented for us to do so);
    • to show you adverts as you browse the website;
    • to direct you to the right part of the website; and
    • to communicate with you.
  • No matter how we specifically use the information provided to us, we have been careful to ensure that, at all times, we have a lawful basis for processing your personal data in terms of Article 6 of the GDPR. Our lawful basis for processing your data may include:
  • where you specifically consent to our processing of your data for one or more specific purposes: For example, if you have agreed to our Terms and Conditions and to the terms of this Privacy Policy, you have specifically provided us with consent to use your personal data for things such as sending you service messages; and
  • where processing your data is necessary for compliance with a legal obligation to which we are subjects: for example, in some situations, we may be obliged by law to provide your personal information to the lawful authorities. For example, if you are the subject of criminal compilation proceedings, we may be required to provide data relating to your activity on the website.
  • Any personal data that you provide us with during the registration process will be stored in our database and may not need to be re-entered with each new booking, in order to provide a smoother user experience.
  • Please note that our ability to provide you with services through the website may be partially or completely inhibited if we delete your personal data at your request.
  • Any personal data being held with regard to any accounts which are inactive for a period of two (2) years will be automatically deleted.
  • No personal data will be stored, in any circumstance, beyond the legal retention periods allowed by Maltese law and, where applicable, European Union law.  
  • Sharing your Data with Third Parties
  • In certain circumstances GTB may share the information that you share with them with other organisations outside of GTB. The third parties who we might share your data with include:
  • Service Providers;
    • Third party support services;
    • Payment processors and other financial institutions;
    • Referring websites;
    • Business affiliates; &
    • Law enforcement authorities.
  • Whilst GTB has procedures and security features to protect your information from access by unauthorised persons and against unlawful processing, accidental loss, destruction and damage, GTB does not control the privacy practices of any of the abovementioned organisations and therefore you are encouraged to review their own privacy policies where appropriate.
  • Furthermore, any information that you provide directly to third parties is not covered under this Privacy Policy and thus you are encouraged to check their own privacy policies before sharing any personal information.
  • Marketing Communications 
  • If you opt in to receive marketing communications from us, you consent to the processing of your data to send you such communications, which may include newsletters, blog posts, surveys and information about new events. We retain a record of your consent. 
  • You can choose to no longer receive marketing communications by contacting us at explore@globaltravelbook.com or clicking unsubscribe from a marketing email. If you do unsubscribe to marketing communications, it may take up to 5 business days for your new preferences to take effect. We shall therefore retain your personal data in our records for marketing purposes until you notify us that you no longer wish to receive marketing emails from us.

  • A cookie is usually a small piece of data sent from a website and stored in a user’s web browser while a user is browsing a website. Cookies allow our website to keep track user activity on our website and allow us to analyse such activity to provide you with a better booking experience.   • We undertake to store and, or to transmit your data in a manner that ensures security against unauthorised access, alteration or deletion, at a level commensurate with its sensitivity. To ensure that your data is treated securely and in accordance with this privacy policy we will endeavor to take all reasonably necessary steps in protecting your privacy. We will do our best to protect your personal data. All information you provide to us is stored on our secure servers. However, we have no control over the transmission of information over the internet and therefore cannot guarantee the security of data transmitted to our sites. 
  • While we undertake to take all commercially reasonable steps to guarantee the security of all credit card and all other personal information, we unequivocally relieve ourselves from any liability and take no responsibility for any unauthorized access to or use of our secure servers and/or any and all personal information and/or financial information stored therein, and you agree to hold us harmless for any damages that may result therefrom. Hence, any transmission of data is at your own risk. 
  • Some or all of your personal data may be stored or transferred outside of the European Union (the EU) for any reason, including for example, if our email server is located in a country outside the EU or if any of our service providers or their servers are based outside of the EU. We shall only transfer your personal data to organisations that have provided adequate safeguards in respect of your personal data.

Therefore, you should check these before submitting any personal data. We cannot accept any responsibility or liability for any policies made by third parties.

  1. As an individual you may exercise your right to access the data held about you by GTB by submitting your request in writing to the Data Controller.
    1. Although all reasonable efforts will be made to keep your information updated, you are kindly requested to inform us of any change referring to the personal data held by the association. In any case if you consider that certain information about you is inaccurate, you may request rectification of such data. 
  1. If you have any complaints in relation to this Policy or otherwise in relation to our processing of your personal data, you should contact the Maltese supervisory authority: The Office of the Information and Data Protection Commissioner. 
  1. You also have the right at any time to require that we delete your personal data and request data portability. 
  1. Changes to the Policy 
  1. We may change this Policy from time to time without notice as we add new services or features or in response to changes in the law or our commercial arrangements. Any changes to this Policy will be posted on the website.  
  1. In changing this Policy, we undertake: 
  1. not to materially change these terms in a manner that reduces protection for your data; 
    1. where changes are made to these terms, to ensure that the differences between successive versions are readily accessible; and
    1. to maintain all prior versions of these terms in such a manner that they are dated, and readily accessible. 
  1. Governing Law and Jurisdiction 
  1. This Policy shall be governed by and construed in accordance with the laws of Malta. By accessing this website, you consent to the exclusive jurisdiction of the courts of Malta in all claims or disputes arising in relation to or in connection with this website and its use and the privacy policy.

  1.  Disclaimer Form and Waiver from Liability
  1.  A disclaimer form and waiver from liability (the “Declaration”) for participants in activities         organised by Globaltravelbook LTD (the “Organiser”), which events are held both locally within   the Maltese territory, as well as overseas. All information contained herein is legally binding on the person signing this Declaration by selecting the checkbox before completing a booking (the “Participant”) in relation to any activities and/or events set up by the Organiser. The Organiser and the Participant shall be referred to collectively as the “Parties”. The Participant shall not participate in any activities and events organised by the Organiser prior to agreeing to the terms and conditions of this Declaration.

Statement:

By signing this document (ticking checkbox before completing booking), the Participant agrees and affirms that no charges or monetary claims concerning personal damages and/or other claims whatsoever may take place as a result of the Participant’s involvement in activities and/or events set up by the Organiser. Furthermore, no charges or claims will be brought forward against the Organiser or any associated persons for damages that may arise as a direct or indirect result of taking part in any event and/or activity set up by the said Organiser.  

The Participant understands that the activity and/or event they are participating in carries with it inherent risks which may involve physical injury to one’s own person as a direct or indirect result of their participation. The Participant hereby declares that they are fully aware of this before signing the Declaration.  

The Participant understands that the activity and/or event may be physically and mentally demanding and as such may require the Participant to be well trained and ready for the challenge. The Participant declares that they shall not hold the Organiser responsible for any personal injury that they may suffer due to over exhaustion, strain or any other cause whatsoever. The Participant further declares that any action which may give rise to any injury during the trip, or any effects thereof which may be felt after the activity and/or event, shall be the sole responsibility of the Participant, and consequently the Organiser is to in no way be held liable for any such injury or related effects. The participant also declares that any adequate insurance policies are in place before undergoing any activity offered by the Organiser.

The Participant understands that the activities they will be taking part in may be dangerous, especially if not conducted with due caution, and declares that they shall take full responsibility for any damages that they may sustain as a consequence of participation in such activities.

This document is legally binding and may not be altered.

All personal data contained in this Declaration shall be processed in accordance with Regulation (EU) 2016/679 of the European Parliament and of the Council of 27 April 2016 on the protection of natural persons with regard to the processing of personal data and on the free movement of such data, and repealing Directive 95/46/EC (General Data Protection Regulation) (“GDPR”).

Unless it is necessary for Globaltravelbook LTD to retain the Participant’s personal data following the completion of any organised event, the Participant’s data shall be retained by Globaltravelbook LTD for no longer than necessary following such completion, after which Globaltravelbook LTD will delete, pseudonymise or anonymise such data. Certain personal data may be retained if so required by law and/or in the event of a potential or impending dispute or claim relating to any organised event.

The Parties agree to submit to the exclusive jurisdiction of the Maltese Courts.
